I. T. MUHAMMAD, JCA (Delivering the Leading Judgment): The respondent, as plaintiff instituted the suit giving rise to this appeal against the appellant as defendant at the High Court of Justice of Federal Capital Territory claiming the sum of ₦3,405,107.63 (Three million, four hundred and five thousand, one hundred and seven thousand naira sixty-three kobo) and 10% interest rate on the same sum until the entire judgment debt is liquidated. The action was commenced under the undefended list procedure. The fact of the case can be summarized as follows:

The plaintiff vide a letter of award dated the 6th day of January, 1998, was awarded a contract by the defendant to construct 2 Nos.of Block/Units of MASFA house type at Gwarimpa II estate in the sum of ₦25,049,648.36 (Twenty-five million, forty-nine thousand, six hundred and forty-eight naira thirty-six kobo).
