HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the Ogun State High Court of Justice, sitting at Abeokuta, delivered on the 14th day of August, 2009 in Suit No: AB/181/2006.

In the Court below, the Respondent herein who was the Plaintiff commenced his action against the Appellants by way of an Originating Summons dated and filed on the 21/8/2006. By the Originating Summons, only one question was presented to the Court for determination as follows:

Whether the purported impeachment of the Plaintiff from office as the Chairman of the Abeokuta South Local Government by 1st 15th Defendants on 9th January, 2006 was in accordance with the provisions of Section 37 of the Local Government Law of Ogun State, 2000.

The Plaintiff/Respondent then sought that if the above question is answered in the negative, the trial Court should grant him the following reliefs:
