JUDGMENT
INTRODUCTION
This is a one-sided judgment owing to the defendants’ failure to testify. Following the parties’ failure to settle at the pre-trial settlement conference, issues were set down for trial. On 29th May 2025, the court directed the parties to file their witness statements and pre-trial checklists. The matter was adjourned to 10th July 2025 for case management conference. On that date, the plaintiff failed to file his witness statement and pre-trial checklist and the matter was adjourned to 22nd July 2025. On that date, the defendants acknowledged service of the plaintiff’s witness statement and were ordered to file their witness statements within 14 days. The matter was adjourned to 9th October 2025, and then to 27th October 2025, for case management conference. When the defendants failed to comply with the court’s directives by 27th October 2025, their statements of defence, filed on 18th October 2024 and 9th April 2025, were struck out pursuant to Order 32, Rule 7A s…
