JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): This appeal is a fall out of the judgment of high court of Lagos State in Suit No. LD/3337/97 delivered on 19th December, 2013 by Hon Justice O.A. Oyekan–Abdullahi.
The lower court entered judgment in favour of the Respondent/Claimant against the Appellant/Defendant in the sum of N25,000,000.00 general damages. Obviously piqued by this decision the appellant filed appeal to this court on 19th February, 2014. The notice of appeal contains five (5) grounds of appeal.
The appellant seeks the following relief:
“An order setting aside the judgment of the high court of Lagos State presided over by O.A. Oyekan – Abdullahi J. in the judgment delivered on the 19th of December, 2023 in suit No. LD/3337/97 and in its stead a judgment of the court of appeal dismissing the Respondent’s claim in its entirety”.
