JUDGMENT

The plaintiff herein, Francis Ebo Abrahams, until 31-07-2009, was an employee of the defendant, Hotel Investments (Gh.) Ltd., which operates the Labadi Beach Hotel in Accra.
The plaintiff’s employment took effect from 01-10-2000. On 31-07-2009, the defendant dismissed the plaintiff by letter which has been tendered in this court as Exhibit K. The relevant part of the said letter states as follows:
“Please be advised that you are hereby dismissed from your employment at the Labadi Beach Hotel for gross misconduct.
On 17th July 2009, you were called by the hotel’s security personnel three times to attend to an urgent situation regarding the discharge of water you had ordered for the hotel. You ignored their calls and instead conducted a private telephone conversation on your mobile phone contrary to hotel procedure. When confronted, you lied that you were cleaning a chandelier on the hotel terrace which turned out to be untrue.
