JUDGMENT
On 23-01-2008, the plaintiff, Francis Fobi, caused a writ to be issued from the registry of this court by which he claims the following reliefs:
1. A declaration that house no. C 50/12 renumbered as house no. C 473/11, Accra New Town, Nkansadjan is his property.
2. Recovery of possession of the disputed house.
3. General damages for trespass.
4. Perpetual injunction restraining the defendants, their agents, assigns, workmen, etc. from having anything to do with the disputed house.
The case of the plaintiff, as stated in his statement of claim, is that the 1st defendant, Kofi Boateng, who is his first cousin introduced one Madam Ramatu Futa (the original owner of the house in dispute) to him and he purchased the said house. After purchasing the house, he gave the receipt, indenture and other documents of the house to the 1st defendant to process for him at the Lands Department.
