IGE, J.C.A. (Delivering the Leading Judgment): This is an appeal by the plaintiff/appellant against the judgment of Okungbowa J. of Sapele High Court in suit No. S/12/87 delivered on 16/4/91.
In the court below the plaintiff now appellant in this case claimed against the defendant/respondent a total sum of N2,530,000.00 as special and general damages for breach of contract.
The facts of the case are that on or about the 7th day of May 1984 the defendant a limited liability company from their Factory AT&P in Sapele agreed to supply to the plaintiff a Trader some specified quantities of Timber Products. The plaintiff agreed to buy the said quantities of Timber Products as contained in SMM/S4/279 of 7/5/84. The plaintiff stated that by the said agreement he was a large or major distributor of the defendants' goods.
