CHIDI NWAOMA UWA, J.C.A. (Delivering the Leading Judgment): The appeal is against the judgment of the High Court of Lagos State delivered on the 14th day of June, 2016 by M. Olokoba J, in which the claims of the appellant were dismissed. The appellant as plaintiff at the trial Court claimed as follows:
i. A declaration that the outstanding balance payable to the 1st defendant is N700,641.00 and that any purported sale of the property in this suit by the 1st defendant to any other person except the claimant is inequitable, invalid, null and void.
ii. An order of specific performance of the contract of sale of land dated 20th April, 1998 between the 1st Defendant and the Claimant or a declaration that the land has been validly sold to the Claimant since September, 1998 when the 1st Defendant executed a Deed of Assignment of the land subject of this case to the Claimant.
