JUDGMENT
INTRODUCTION
1. The Plaintiff, Gafat Consult Limited (GAFAT), is a Limited Liability Company registered under Ghanaian law, and is engaged in Information Technology and Mobile Money vending. The 1st Defendant, Mobile Sport (MSPORT), is a betting company also registered under Ghanaian law. The 2nd Defendant, Mr. Benjamin Boateng, at the time the incident that gave rise to this present action was an employee of GAFAT. It is alleged that Mr. Boateng was entrusted with the GAFAT's MTN Mobile Money Merchant Number 0597394547, to purchase gold, but he used an amount of GHS 400,000.00 standing to the credit of GAFAT on the wallet to place bets on MSPORT's betting platform.
2. GAFAT alleges that MSPORT breached its regulatory guidelines by allowing Mr. Boateng to use GAFAT's Corporate Mobile Money Merchant Account for betting, which resulted in financial loss to GAFAT.
