UWA, J.S.C. (Delivering the Leading Judgment): The appeal is against the judgment of the Court of Appeal, Kaduna Division (court below), delivered on 22nd September 2020, which affirmed the appellant’s conviction for the offence of Armed Robbery.
The brief facts of the appeal are that the appellant, along side two others, were charged with Conspiracy to commit Armed Robbery and Armed Robbery punishable under sections 1and 6(b) of the Robbery and Firearms (Special Provisions)Act, Laws of the Federation of Nigeria (LFN) 2004. It was the respondent’s case at the trial court that the appellant and his co-accused persons broke into the apartment of the PW1 and PW2,and carted away several valuables, including two iPhones, a Samsung Television, an HP laptop, an Apple Laptop, jewellery, and cash of N35,000.00 (Thirty-Five Thousand Naira).
