STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This appeal is against the decision of the High Court of Federal Capital Territory, Abuja in Suit No: FCT/HC/CV/1459/2013. Coram: A.S. Umar J., delivered on the 14th day of December, 2016.

The Appellant as the Plaintiff before the trial court by an Amended Writ of Summons and Statement of Claim prayed for the following reliefs against the Defendants:

1. A Declaration that the property lying and situate at Apo Resettlement Zone E No. 150 BQ belong to the Plaintiff in this manner.

2. A Declaration that the purported sale of the above property by the Defendant to the 3rd party is null and void since the Defendant has no proprietary interest to transfer same to anyone.

3. An Order of this Honourable Court directing the illegal occupants to quit from property lying and situate at Apo Resettlement Zone E No. 150 BQ which belong to the Plaintiff.
