HAMMA AKAWU BARKA, JCA (Delivering the Leading Judgment): The instant appeal is against the decision of the High Court of Justice, Cross River State sitting in Calabar, and manned by Hon. Justice Edem Ita Koofreh; delivered on the 16th day of January, 2017. By the said judgment, the court held that the respondents, now appellants, breached the respondents fundamental rights as provided for by sections 34 and 35 of the Constitution of the Federal Republic of Nigeria 1999 as amended, and thereby entered judgment in favour of the applicants as follows:-
