SANUSI, J.C.A. (Delivering the Leading Ruling): A motion on notice dated 23rd of June, 1998 was filed in this court in which the applicant/appellant sought the following order:-

"An order of injunction restraining the defendant/respondent, its agents, servants, privies, assignees or howsoever called from alienating, setting, disposing or of assigning the land in dispute and/ or from ejecting the appellants/applicants' community therefor or interfering with their possession thereof and/or from disturbing, harassing, molesting or assaulting the appellants/applicants' community on the said land pending the determination of the appellants/applicants' appeal.

The complaint of the applicants is that sometimes in 1990, the respondents through its agent Julius Berger Nigeria Limited entered into Ogoyo village and started destroying the houses and other properties belonging to the members of the Community in the village and commenced sand filling the village.
