[1] George Ngata Njogu, who is now the applicant, was an interested party in Judicial Review proceedings that was brought in the High Court at Nakuru by Jonah Goodwin Kariuki Kaniu, who is now the 1^strespondent. The proceedings in the High Court were concluded in favour of the 1^st respondent when the High Court (Maraga J. as he then was) delivered a judgment on 10^th February, 2010 and issued an order of mandamus compelling the Municipal Council of Naivasha, the Commissioner of Lands and the Director of Physical Planning (now the 2^nd, 3^rd and 4^th respondents), to implement plan No.105 dated 17^th Against 1995 and restore plot No.158 to its original size and ground location in accordance with the approved plan No.105 of 17^th August, 1995.
