This is an application for summary judgment. I have read the application and the supporting affidavit. I have also read the affidavit in opposition. I have listened to both counsel for and against the motion. Consideration has been given to the principles governing the grant or otherwise of applications of this nature. It is my view that the affidavit in opposition filed by the defendant/respondent does not disclose any defence. In the circumstance the application should be granted. Same is granted. Summary judgment is accordingly entered for the plaintiff/applicant in the sum of USD269,020.50 with interest calculated at 19.65% from 5th January, 2016 to date of final payment. I award costs of GH¢30,000.00 in favour of plaintiff.
