JUDGMENT
In this case, Plaintiff sued three (3) Defendants. At the end of the day however, it was 3rd Defendant who procedurally brought matters to a stage by which the battle was joined with Plaintiff for determination. In other words, the dispute launched by Plaintiff was at the end of the day, set against 3rd Defendant, the 1st and 2nd Defendants falling off along the way.
Although the suit was commenced in 2013, due to so many intervening factors, it was not until 2016 that Plaintiff and 3rd Defendant by their respective lawyers appeared before the Court for final directives as to the made of trial of the case. That is on the 12th December, 2016, Plaintiff and his lawyer and lawyer for 3rd Defendant were in Court and upon agreement by the said lawyers the case was adjourned to 20th-24th March, 2017 for hearing, after the Court had earlier on directed the filing of witness statements so as to expedite the trial and the witness statements had duly been filed.
