RULING

I have listened to the submission by counsel for the Plaintiff for judgment in default of appearance against the Defendant.

I have also gone through the documents filed in this application. The Plaintiff in its amended Writ of Summons filed on 9 June, 2023 claimed from the Defendant an amount of GH¢922,283.07.

The Plaintiff in paragraph 8 of its amended statement of claim averred, that it provided services for the Defendant between April, 2017 and February, 2020 which has resulted in the amount claimed.

However, the Plaintiff attached a document dated 6 November, 2017 to its application. It has been marked as exhibit ‘G5’. In the said document, the Plaintiff stated, that it has terminated its service in respect of the service order and IRU connectivity with the Defendant.

The court does not know whether any contract or agreement was made between the parties after exhibit ‘G5’ was written. This is because; in exhibit ‘G5’, which is dated 6 November 2017, the Plaintiff indicated that …
