STEPHEN JONAH ADAH, J.C.A.: (Delivering the Leading Judgment): This appeal is against the judgment of the Akwa Ibom State High Court in Suit No. HU/287/201l delivered on 6th day February, 2014, coram. P. P. Idiong, J.

The facts of this case are straight forward. The Respondent in this appeal, as Plaintiff took out a writ of summons of the Lower Court on 6th July, 2011 wherein he claimed the following reliefs:

1. The sum of N10, 000.000.00 (Ten Million Naira) only as damages for defamation of the Plaintiff by the Defendant.

2. A publicly published written apology and a retraction of the defamatory words in one National and Local Newspaper.

The Respondent's case before the Lower Court is predicated on a letter of dismissal the Appellant issued to one of its employees, Yakedoho Ndem Onoyom. Under the reason that the said Yakedoho Ndem, had allowed the Respondent, who was earlier dismissed for theft, into the Appellant's premises.
