This ruling is in respect of motion on notice for joinder under Order 4 Rules 4 and 5 of CI 47 filed by one Stephen Appiah Bugyei and 182 others on 25th September, 2008.
The applicants submit that they were all former employees of the defunct State Fishing Corporation who were retrenched in 1995 but were not paid their due severance awards. They as a result took action at the High Court, Accra in suit No. C.73/95 titled Godfred Aryeeteyman and Ors. v. State Fishing Corporation for the payment of their entitlements.
Judgment was delivered in their favour in 1996 and portions of their entitlements were paid to them by the Government of Ghana leaving the balance of 42.5% of the judgment debt yet to be paid to them.
Unknown to the applicants, the plaintiffs herein who were also members of the retrenched employees and for that matter plaintiffs alongside the applicants in the suit instituted against the State Fishing Corporation in 1995 have instituted an action at the High Cour…
