DANLAMI ZAMA SENCHI, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment of the High Court of the federal Capital Territory, Abuja in Suit No. FCT/HC/CV/36/07 delivered by O. O. Goodluck J. on the 6th day of December, 2011. The Appellant, as Plaintiff before the Lower Court, commenced this action vide a Writ of Summons and Statement of Claim dated 21st November, 2007. The Statement of Claim was Amended by the Order of the Lower Court filed on 13th March, 2008 and further amended but filed on 1st July, 2008. Thus, by the Further Amended Statement of Claim, the Appellant (as Plaintiff) claimed before the Lower Court as follows:
(1) A declaration that the Plaintiff is the bonafide owner of Block 3A Flat E 1st Avenue, Gwarimpa, Abuja.
