 JUDGMENT 

The plaintiffs, Godfrey Darko and Hilda Tutua Darko caused a writ of summons  to be issued out of the registry of this court for the following reliefs; 

1. Declaration of title to the land described in paragraph 2 of the statement of  claim; 

2. Recovery of possession; 

3. An order for demolition of any structure on the land in dispute;

4. Perpetual injunction; and  

5. Damages for trespass. 

In their statement of claim, the plaintiffs asserted that in 1989, they acquired a  parcel of land measuring approximately 0.300 of an acre located at Gbawe East  (McCarthy Hill) from the Jamestown Mantse, Nii Ababio. After paying the  requisite consideration agreed upon, they were put in possession of their land,  around which they built a wall and a wooden structure for their caretaker.
