J U D G M E N T

BARTELS-KODWO, J.A:

On the 10th December, 2020 the trial court convicted and sentenced the 2nd accused now Appellant person on the following charges.

The Appellant was charged with the offence of engaging in criminal conspiracy to commit an offence; to wit importation of narcotic drugs contrary to section 56 (c) and 1 of the Narcotic Drugs (Control, Enforcement and Sanctions) Act, 1990 (PNDCL 236). He was also charged with the Importation of narcotic drug without license issued by the Minister for Health contrary to section 1 (1) of Narcotic Drugs (Control, Enforcement and Sanctions) Act, 1990 (PNDCL 236). As well as with the possession of narcotic drug without lawful authority contrary to section 2 (1) of the Narcotic Drugs (Control, Enforcement and Sanctions) Act, 1990 (PNDCL 236).

He pleaded not guilty on all the three counts and after trial he was convicted on all three counts and sentenced to a term of ten years imprisonment on all the counts to run concurrently. This…
