IBRAHIM SHATA BDLIYA, J.C.A. (Delivering the Leading Judgment): By a Writ of Summons and statement of claim filed on the 15th of November, 2012, the respondent as plaintiff instituted suit No.KDH/KAD/955/2012, against the 1st and 2nd appellants (as the defendants) seeking for the following reliefs:
(i) The sum of N23,618,472.84 (Twenty Three Million, Six Hundred and Eighteen Thousand Four Hundred and Seventy-Two Naira, Eighty Four Kobo) being the outstanding indebtedness of the defendants jointly and severally to the plaintiff as at 30th day of September, 2012 on account of RENEWAL OF CREDIT FACILITY granted by the plaintiff to the 1st defendant on current account No: CA1010678081, otherwise called "GORKEENS LIMITED - GUINNESS DEDICATED ACCOUNT" and guaranteed by the 2nd defendant.
(ii) Interest on the said sum of N23,618,472.84 at the rate of 17% per annum from the 1st day of October, 2012, until judgment and thereafter at 17% per annum until final liquidation of the judgment sum.
