Introduction

This is an appeal against the decision of the High Court, Accra (Human Rights Division) to dismiss the Order 67 Motion brought by the Applicant/Appellant (hereinafter referred to as the “Appellant”) on grounds of the action having been prematurely commenced. Dissatisfied with the ruling of the High Court, the Appellant brings the instant appeal.

According to the originating motion filed pursuant to Article 33 of the 1992 Constitution of Ghana and Order 67 of the High Court Civil Procedure) Rules 2004 (C.I. 47), by the Appellant on the 12th of June 2023, the Appellant, an LLM student at the University of Ghana’s School of Law, is a customer of the 1st Respondent/Respondent (hereinafter “Respondent”). The Appellant avers that on 2nd May 2023 he realised that a Vodafone number which did not belong to him had been registered in his name with his identity, without his consent by the 1st Respondent.
