JUDGMENT

The present appeal before this Court is against the decision of the High Court, Accra delivered on 29th June, 2020. The unconverted facts of the case were that the 1st Defendant in an earlier suit obtained judgment against the Plaintiff/ Respondent in this appeal and attached his property with number 401/12 Teshie Estate to be auctioned. The 2nd Defendants are the administrators of the estate of the late Jacobus Vanderpuye, the auctioneer who auctioned the property. The 3rd Defendant was the buyer who bought the property at the auction organised by the late Jacobus Vanderpuye in his capacity as an auctioneer. The Plaintiff who claimed to have paid for the property through a private treaty sued the Defendants in the High Court, Accra to invalidate the auction sale of the house organised by the late Jacobus Vanderpuye, on 9th April, 2015 and the certificate of purchase issued by the Court to the 3rd Defendant in respect of the auction on grounds of fraud.
