ADZIRA GANA MSHELIA, J.C.A.(Delivering the Leading Judgment): The Respondent herein as the plaintiff at the plateau State High Court took out a writ of summons under the undefended list against the Appellants (who were defendants jointly and severally) for the total sum of Eighty Million Naira (N80,000,000.00) being the outstanding legal professional fees per legal work/service rendered at the Appellants instance. The motion ex-parte dated 30th June, 2015 seeking for an order placing the suit under the undefended list was supported by a 7 paragraph affidavit and Exhibits "AA1 -AA20". The application was granted and the suit was placed under the undefended list. The Appellants (as Defendants) filed their Notice of Intention to defend the suit, supported by 42 paragraph affidavit.
