THERESA NGOLIKA ORJI-ABADUA, J.C.A. (Delivering the Leading Judgment): By the Statement of Claim filed by the Respondent on the 11th April, 2019, the Respondent was appointed as a Commissioner For Public Utility by the Ekiti State Government via the Ekiti State Governor on the 16th August, 2017 and which appointment was stated to be at the pleasure of the Governor. Then at the end of the Claimant’s tenure on the 15th October, 2018, the Defendants were indebted to him to the tune of N3,935,963.94 as salaries, entitlements and allowances which the Defendants failed, neglected and or refused to pay. The said indebtedness was acknowledged by the Defendants via a letter dated the 3rd October, 2018. Due to clear refusal of the Defendants to pay off the debt, the Claimant then instituted the action that generated this appeal wherein he claimed against the Appellants as follows:
