HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Oyo State High Court, sitting at Ibadan delivered on the 02/8/2002 in Suit No: I/654/95.

By a Writ of Summons filed on the 01/6/95 and a Statement of Claim dated the 25/10/95 and filed on the 26/10/95, the 1st Respondent who was the Plaintiff sought against the Appellant and 2nd Respondent jointly and severally as follows:

1. The sum of N1,289,150.21 (One Million, Two Hundred and Eighty-Nine Thousand, One Hundred and Fifty Naira, Twenty-One Kobo) being balance of the agreed Plaintiffs pre-contract professional fees in respect of the consultancy services rendered by the Plaintiff on the renovation of Premier Hotel, Ibadan pursuant to an Agreement dated 20th September, 1994 between the Plaintiff and the 1st Defendant which project was subsequently transferred to the 2nd Defendant by the 1st Defendant but the 2nd Defendant refused to settle the above balance of the Plaintiffs fees in…
