ODUYEMI, JCA (Delivering the Lead Judgment): On 29th January, 1997, plaintiff now appellant in this court obtained from the High Court of the Federal Capital Territory, Abuja in a suit in the Court’s Undefended List against the defendants now respondents, in this court, for goods supplied and delivered in the following terms:-
US $4,178,236.85 being the principal debt.
US $ 611,312.08 being the costs of demurrage
Total US $4,789,548.93
with interest at the rate of 21% per annum as from January, 1994 to formal liquidation of the judgment.
By a motion on notice filed in the same court on 19th September 2000, the plaintiff/judgment creditor sought for the following orders against the defendants/judgment debtors:-
