SAIDU TANKO HUSSAINI, J.C.A. (Delivering the Leading Judgment): The Appellant commenced action as Plaintiff at the High Court of Justice, Adamawa State, Yola Judicial Division and claimed against the Respondent as defendant the reliefs set out in the Statement of claim as follows:

1. A declaration that the Plaintiff is the rightful owner of shop No. G. 016 at the Jimeta Ultra Modern Market which is allocated to him buy Hon. Caleb Tabwasa the then Chairman of Girei Local Government Council during Boni Harunaregime as governor of Adamawa State.

2. An order directing the Defendant to pay the Plaintiff the annual rent of two Hundred and fifty Thousand naira (N250, 000. 00) for each year which the defendant use to collect from the person he unlawfully put on occupation from September, 2009 to date.

3. The sum of Two hundred Thousand Naira (N200, 000. 00) as general damages.

4. Cost of this litigation.

5. Any further and better relief(s) as this Honourable Court may make in the circumstances.
