OKUNOLA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Katsina State Sharia Court of Appeal, holden at Katsina affirming the decision of the Upper Area Court, Mani, Katsina State. The appeal to the Sharia Court of Appeal was accordingly dismissed.

The claim of the Plaintiff/Appellant (hereinafter referred to as the appellant) at the tipper Area Court Mani after this case had been transferred there from the Upper Area Court Toro as per page 1 of the records of proceedings is as follows: -

" Alhaji Sule said he is suing Ladan Hassan Doro because my father lend him the farm 35 years ago now, and when my father died I was very small boy, all the estate which I inherited was given to him as if I grow up he should hand over the heir to me, but it happened Ladan Hassan sold out all these properties and buy (2) two farms with the money of my heir. That is the reason why I sued Ladan Hassan Doro seeking the court to investigate and collect back my father…
