BA'ABA JCA (Delivering the Lead Ruling): This is a motion brought pursuant to section 29 of the Court of Appeal Act, section 341(2) of the Criminal Procedure Code and sections 36(5), 45(1)(2) of the Constitution of the Federal Republic of Nigeria, 1999 by the appellants/applicants, praying for the following orders: “(1) An order of tshis honourable court directing the release of the appellants/applicants on bail pending the hearing and determination of the appellants/applicants’ appeal to the Court of Appeal, Kaduna. (2) And such further order(s) as this honourable court may deem fit to make in the circumstances of this case.” The motion is supported by a 16 paragraph affidavit in support of the motion and 10 paragraph counter-affidavit and a further affidavit of 20 paragraphs.
