JUDGMENT
The Convict/Appellant (hereafter referred to as Appellant) was sentenced to a term of imprisonment of 4 years having been found guilty of the offence of Threat of Death, contrary to Sec. 75 of the Criminal and Other Offences Act, 1960, Act 29 by the Circuit Court, Goaso, on 20th October, 2023 (Coram: H/H Charles Kwasi Acheampong). Upon a successful application for extension of time to appeal, he filed on 18th July, 2024 a Notice of Appeal in which he set down two grounds of appeal, to wit:
a. That the sentence was harsh and excessive having regard to the circumstances of the case; and
b. That the conviction cannot be supported having regards to the circumstances of the case.
The facts on which the case is based are as follows. One Adwoa Brenya, now late is said to have entered into a customary farming tenancy agreement (abunu) with the Complainant.
