UMOREN JCA (Delivering the Lead Judgment): The suit that gave rise to this appeal was instituted before the Anambra State High Court, sitting in Onitsha in suit No. 0/671/2001 before the Hon. Justice M. A. Onyiuke dated 5th December 2001, in the undefended list. The claim of the plaintiffs as respondents in this court against the defendants as appellants in this court was for:

(a) N6,200,000.00 (six million, two hundred thousand naira) being a friendly interest free loan;

(b) 10% interest on the said sum.
