JUDGMENT

SITTIE, J.

Plaintiff a Ghanaian incorporated company operating a number of educational  institutions instituted this action against the Defendant for a declaration of title  to all that land covering 41.786 acres situate at Amrahia-Adamrobe, and  delineated on Land Title Registry Plan No. Y1224, an order for perpetual  injunction, recovery of possession and damages for trespass. 

Plaintiff averred that he acquired the land subject matter of dispute from the Nii  Okromansah Family of Adamrobe and Tete Pa Ogya Agona Family also of  Adamrobe who executed two separate Deeds of conveyances dated 1st January  2004 and 30th June 2008 respectively in its name. Plaintiff averred that it took  possession of the land and constructed a school block, dormitories, staff  accommodation among others for the purposes of operating a boarding school.  Plaintiff said it sold portions of the land to third parties some of whom have  developed and occupy houses they built on the land.
