HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Lead Ruling): The action leading up to this appeal was commenced by the Appellant in the lower Court against the Respondents and it was by way of an action for judicial review for an order of certiorari to quash and question the entire proceedings, judgments, rulings and decisions of the first Respondent in Suit No PDCVI/38CV/2013 - Mahmud A. D, Rufai v. Dr. Muhammad Lawal Hedejia and pursuant to which the Appellant was forcefully and illegally ejected and disposed of the property lying at No 23, Makurdi Road; Old GRA Bauchi. The lower Court dismissed the claims of the Appellants in a judgment delivered on the 4th of February, 2014 and consequent on which the Appellant filed the present appeal. The Appellant died sometime in 2014 after the filing of and the entry of the appeal in this Court.
