(Delivering the Leading Judgment): This appeal is against the Ruling of the Kaduna State High Court of Justice delivered on 15/5/2007 by Esther Y Inuwa J, setting aside its judgment of 12/10/2006 and an order that the Appellant pay the Respondent the sum of N1, 079,785.00 (One Million seventy Nine Thousand, Seven Hundred and Eighty Five Naira only).
The facts leading to this appeal are briefly stated as follows.
