(Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Kaduna Judicial Division, in Appeal No. CA/K/140F/C/2017 delivered on the 9th day of February, 2018, wherein the Court below affirmed the judgment of the trial High Court of Kano State, which  convicted the Appellant of the charge of criminal conspiracy and armed robbery punishable under Sections 97 and 289 of the Penal Code Law of Kano State.

The Appellant, alongside 5 (five) others, was arraigned on a two-count charge of criminal conspiracy and armed robbery, which is reproduced hereunder thus: 

That you Alhaji Tahir Yahaya, Salisu Adamu, Usman Hamza, Sani Ayuba, Muhammed Musa, Maikudi HaHiu and Aiiyu Absulhamid on or about the 5th September, 2007 at about 1930hrs at No. 900 Muhammed Gauyana Road Hotoro GRA in Nassarawa Local Government Area, Kano State within the Kano Judicial Division agreed to do an illegal act, to wit; rob Aisha Muhammed Yakasai of No 900…
