MOHAMMED BABA IDRIS, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Kaduna Judicial Division, in Appeal No. CA/K/140F/C/2017 delivered on the 9th day of February, 2018, wherein the Court below affirmed the judgment of the trial High Court of Kano State, which convicted the Appellant of the charge of criminal conspiracy and armed robbery punishable under Sections 97 and 289 of the Penal Code Law of Kano State.
The Appellant, alongside 5 (five) others, was arraigned on a two-count charge of criminal conspiracy and armed robbery, which is reproduced hereunder thus:
