TUNDE OYEBANJI AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is the judgment in respect of the appeal filed by the Appellant, who was the 1st accused in the trial before the lower Court.
The 1st accused was arraigned on a two count charge which read as follows:
CHARGE ONE
That you Abdulmalik Halilu 'm' and Ibrahim Amadu Kamaye Dawa 'm' on or about 14 day of October, 2023 at about 09:00hrs at Dajin Jema bush in Tangaza Local Government Area of Sokoto State within Sokoto Judicial Division did commit the offence of criminal conspiracy in that you agreed among yourselves to commit an unlawful act to wit culpable homicide punishable with death and that same act was committed by you in pursuance of your agreement and you thereby committed an offence punishable under Section 60 of the Sokoto State Penal Code Law, 2019.
