CHIOMA EGONDU NWOSU-IHEME, J.S.C. (Delivering the Leading Judgment): This is an appeal from the decision of the Court of Appeal, Asaba Division, delivered on the 25th day of March, 2022, coram: Hon. Justice Misitura Omodere Bolaji-Yusuff, JCA, Hon. Justice J.E. Ekanem, JCA, and Hon. Justice A.O. Obaseki-Adejumo, JCA, which affirmed the decision of the trial High Court of Delta State delivered on the 31st day of January, 2017. The trial Court had convicted and sentenced the Appellant to death and a term of imprisonment for conspiracy to commit armed robbery, armed robbery, assault, and kidnapping.
STATEMENT OF FACTS
On the 9th of February, 2014, a lady feigning to be deeply distressed and stranded, approached the Victim (PW2) and gained her trust. The assailant (later identified as Theresa) claimed to have purchased merchandise from Cameroon and sought the Victim's assistance in marketing the goods.
