HARUNA SIMON TSAMMANI, J.S.C. (Delivering the Leading Judgment): This appeal is against the judgment of the Court of Appeal, Yola Division delivered on the 6th day of December, 2021 in Appeal No: CA/YL/42C/2021.

Before the Adamawa State High Court of Justice sitting in Yola, the appellant was charged, tried and convicted for the offences of conspiracy to commit culpable homicide and culpable homicide punishable with death contrary to sections 97 and 221 of the Penal Code of Adamawa State. The appellant was the 3rd accused at the trial. They were alleged to have conspired and killed one Pastor Hammanjulde Dadon at Tashan Rake village in Yola South Local Government Area of Adamawa State on the 23rd day of March, 2017.

At the trial, the prosecution called six witnesses who testified as PW1, PW2, PW3, PW4, PW5 and PW6 respectively. The extra-judicial statements of the appellant and those of his co-accused were tendered and admitted in evidence as exhibits A, B, B1, B2, C and C1 respective…
