MOHAMMED, JCA (Delivering the Lead Judgment): This is an appeal against part of the final judgment of the Kano State High Court of Justice, Kano, delivered by Garba Abdullahi J., on 27/10/98. The claim of the plaintiff, now appellant against the defendants, now respondents, as per paragraph 22 of the amended statement of claim is as follows:-
“22. The plaintiff, therefore, claim from the defendants jointly and severally the sum of N800,000.00, being special damages A suffered for loss of use of his funds and or for loss of profit from the supply transaction of wheat flour from 29th August, 1995, until 28th November, 1996, when judgment was entered in his favour.
