JUDGMENT

TUTU, J.

On 7th September 2012, the Plaintiff commenced this action against a defendant  whom he described on the writ as a trespasser. On 8th November 2012, he  amended his writ to include the name of the Defendant. In the said amended Writ,  the Plaintiff claimed the following reliefs on the endorsement on the Writ of  Summons: 

i. A Declaration that the Plaintiff is the owner of the Plot of land at East  Kwabenya Accra, bounded on the North by Donor’s land measuring 85  feet on the South by donor’s land measuring 85 feet on the East by  proposed road measuring 80 feet on the West by donor’s land  measuring 80 feet containing an approximate area of 0.16 acre. 

ii. Damages for trespass. 

iii. Recovery of possession. 

iv. Perpetual injunction restraining the defendant, his assigns, servants,  workers and agents howsoever from interfering with or dealing with the  said plot of land until final determination of the suit.
