BA'ABA JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Kano State High Court holden at Kano State Judicial Division delivered on the 29th day of April, 2002, wherein the trial Court entered judgment on the undefended list against the appellants who were the defendants in favour of the respondent who was the plaintiff at the trial court in the sum of N3,281,000.00.
The respondent by a writ of summons dated the 18th day of December, 2001, claimed against the appellants as follows:
“The plaintiff’s claim against the defendants jointly and severally is for the sum of N3,281,000.00 being the cost incurred by the plaintiff for the finance of a local purchase order issued by Crystal Gas and Oil Limited to Hinterland Resources Limited and for the expenses incurred for the recovery of same to no avail at the written request of the 2nd defendant who is the alter ego and managing director of Hinterland Resources Limited.
