MOHAMMED MUSTAPHA, JCA (Delivering The Leading Judgement): This is an appeal against the decision of the Federal High Court of Nigeria, sitting at Lokoja, Kogi State, in Suit No: FHC/LKJ/CS/23/2022, delivered on the 11th of October, 2022, dismissing the Plaintiff/Appellant's case for lack of jurisdiction.
FACTS IN BRIEF:
The 2nd Respondent in compliance with the guidelines issued by the 3rd Respondent, issued a timetable for the conduct of its primary elections to nominate its candidate for the country, as well as State Houses of Assemblies. The appellant and the 1st Respondent contested for the seat of the lgalamela/Odolu State constituency of Kogi State on the 22nd of May, 2022, at Ajaka, at the end of which the 1st Respondent was declared winner and the valid candidate of the 2nd Respondent.
