NGWUTA, J.C.A. (Delivering the Leading Judgment): Pursuant to the leave granted by the trial court on 17/11/03, the respondent (then applicant) filed a motion on notice dated 20/11/03 on 26/11/03 in which he prayed the trial court for the following reliefs against the appellants (then respondents):
