EMMANUEL AKOMAYE AGIM, JSC (Delivering the Leading Judgement): A primary election of the 1st respondent's candidate for the general election of member House of Representatives for Mushin Federal Constituency II was alleged to have held on 22-5-2022 and was allegedly won by the appellant. It was cancelled by the 1st respondent for reasons that the appellant and 1st and 4th respondents do not agree on. However, they all accepted the cancellation. The 1st respondent cancelled the primary election and fixed a fresh primary election to hold on 6-6-2022. It is in dispute if the primary election of 6-6-2022 held. The appellant was excluded from the primary election and so had no opportunity to participate in the said primary election.
