The plaintiff on the 24th December, 2013 issued a writ of summons against the defendant for the following reliefs;

1. A declaration that Defendant’s failure to refund the arrears of sums advanced to it is unlawful.

2. An order directed at the Defendant to pay the sum of GHS65,306.00 due and owed.

3. Interest on the amount in (b) at the Commercial rate prevailing at the time or know which one is higher on the said amount from when its payment became due in January, 2013 till date of final payment.

4. General damages.

5. Costs incidental to the suit.

6. Any other relief the court deems fit.

The case of the plaintiff is that it entered into an equipment lease agreement with defendant in or about 2012. It is further the case of the plaintiff that FF Construction Ltd obtained a contract to supply laterite to the Ghana Gas Project.
