ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): Appellant filed this appeal, as per the Amended Notice of Appeal, filed on 8/11/2018 and deemed duly filed on 5/2/2019, against the judgment of Enugu State High Court in Suit No. E/84/2008, delivered on 22/9/2016 by Hon. Justice N. Neboh, whereof the trial Court granted the reliefs sought by Plaintiffs and dismissed the counter-claim by the Defendants.

At the trial Court, Respondents (as Plaintiffs) had sought the following reliefs:

1) A declaration that Uwani Ihe, Umuoboko kindreds make up Awene village in Ezema, Olo Autonomous Community.

2) A declaration that Ihe is kindred along with other two kindreds of Uwani and Umuoboko in Awene village.

3) A declaration that Ihe is not a village but a kindred like the other two kindreds and does not enjoy any higher stature, status and or grading from the other two.
