Taylor J. This is an appeal involving the customary law of the Nankanse. As Captain Rattray points out at p.232 of his book on the Tribes of the Ashanti Hinterland, Vol. 1 the Nankanse are popularly known to Europeans as "`Frafra' - from the supposed sound of the word which they use as salutation or in thanks, i.e. fura fura." The plaintiff and the defendant at the court below are both "Frafras".
The claim of the said plaintiff in the court below, now respondent herein, against the defendant who is the appellant before the court is endorsed on his writ of summons as follows:
"The plaintiff seeks judicial relief against the defendant for the return of his wife by name Alahiri Akataba who was given to the plaintiff for marriage by the defendant after he has performed marriage custom and has stayed with the said wife for two years five months and his child Dantini Atambiri aged one year three months whom the defendant is keeping despite repeated persuasion."
